These Terms of Service ("Terms") govern your access to and use of the websites, products, and services offered by Kewise at kewise.com and related domains (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Kewise operates a research directory of landing pages and related advertising creatives compiled from publicly available advertising library data and related public sources. The Service is intended for competitive research, inspiration, and marketing education ‐ not for analyzing a URL you submit for user testing.

Eligibility and accounts

You must be at least 18 years old, or the age of majority in your place of residence if higher, to create an account or purchase a paid plan. By using the Service, you represent that you meet this requirement.

You are responsible for the accuracy of information associated with your account, for keeping login credentials and magic-link access secure, and for all activity under your account. Notify us promptly if you suspect unauthorized access.

We may refuse, suspend, or terminate access to the Service at our discretion, including where we believe these Terms have been violated or where continued access would create legal, security, or operational risk.

The service

Subject to these Terms and your plan limits, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your internal business or personal research purposes.

Features, coverage, rankings, and plan entitlements may change over time. Free access may be limited (for example, fewer pages or ads per brand). Paid plans may unlock broader database access and additional product features as described on our pricing page at the time of purchase.

We may modify, suspend, or discontinue any part of the Service, including specific brands, pages, creatives, presets, or ranking methods, with or without notice.

Third-party content and intellectual property

The Service displays advertising creatives, brand names, logos, landing-page screenshots, destination URLs, and related metadata that belong to third parties. That material remains the property of its respective owners. Kewise does not claim ownership of third-party ads, brands, or websites shown in the directory.

Content in the Service is provided for research and reference. You may not copy, republish, redistribute, sell, or commercially exploit directory content as a competing database, dataset, or feed. Studying patterns and adapting ideas for your own marketing is permitted; wholesale reproduction of the directory or its underlying data is not.

If you believe content in the Service infringes your rights, contact us via our support page with enough detail for us to locate and review the material. We may remove or restrict access to content where we consider it appropriate.

All Kewise names, logos, and product marks are trademarks of Kewise. You may not use them without our prior written consent.

Data accuracy and no professional advice

Advertising data, screenshots, classifications, rankings, estimated spend, reach, runtime, and similar signals are derived from public sources, automated processing, and estimates. They may be incomplete, outdated, inaccurate, or unavailable. Rankings and phrases such as "high-converting" reflect public paid-traffic proxies, not verified private conversion rates, revenue, or ROAS.

The Service is provided for informational purposes only. It is not legal, financial, or marketing advice. You are solely responsible for decisions you make based on the Service.

Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Scrape, harvest, crawl, bulk-download, or otherwise extract data from the Service except through any interface we expressly permit
  • Bypass plan limits, access controls, rate limits, or other technical restrictions
  • Interfere with or disrupt the Service, including through automated abuse of brand imports, search, or other features
  • Use the Service to infringe intellectual property or privacy rights, or to commit fraud or other unlawful acts
  • Reverse engineer the Service except to the limited extent permitted by applicable law
  • Resell, sublicense, or provide the Service or its data to third parties as a competing product or data feed without our written permission
  • Misrepresent your identity or affiliation, or attempt to access another user's account

If you import a brand or otherwise request processing through the Service, you represent that you have a legitimate research interest and will not use the import feature to harass, attack, or overload third-party systems.

Your inputs and feedback

You retain ownership of content you submit to the Service, such as brand import queries, support messages, and account information. You grant Kewise a worldwide, non-exclusive, royalty-free license to use that content as needed to operate, secure, improve, and provide the Service, and to comply with law.

If you send feedback or suggestions, we may use them without restriction or obligation to you.

Fees, subscriptions, and cancellation

Paid access to the Service is offered on a subscription basis as described on our pricing page. Prices, plan features, and billing intervals may change; changes will not affect a billing period already paid unless required by law. Applicable taxes may be added where required.

Payments are processed by Stripe or another payment provider we designate. By purchasing, you authorize recurring charges to your selected payment method until you cancel. You can cancel through the account billing portal or by contacting support. Cancellation takes effect at the end of the current paid billing period unless we state otherwise.

Except where mandatory consumer law requires otherwise, subscription fees are non-refundable for the current billing period once charged, including for partial periods or unused access. If you are a consumer in the EU/EEA/UK with a statutory withdrawal right, you acknowledge that you request immediate access to digital content when you subscribe, and that you may lose the withdrawal right once performance begins, to the extent permitted by law.

We may suspend or terminate paid access for failed payments, chargebacks, or suspected abuse. Where we discontinue a paid plan for reasons other than your breach, we will provide a pro-rata refund for prepaid unused time if required by law or if we choose to do so as a matter of fairness.

Privacy

Our collection and use of personal data is described in our Privacy policy, which forms part of these Terms.

Disclaimer of warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEWISE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DIRECTORY DATA WILL BE COMPLETE OR CURRENT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEWISE AND ITS DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO KEWISE FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $100. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FOR FRAUD.

Indemnification

You will defend, indemnify, and hold harmless Kewise and its affiliates, officers, employees, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your breach of these Terms, or your violation of law or third-party rights.

Termination

You may stop using the Service at any time and may close your account by contacting support. We may suspend or terminate your access immediately if you breach these Terms or if we discontinue the Service. Upon termination, your license to use the Service ends. Sections that by their nature should survive (including intellectual property, disclaimers, limitations of liability, indemnity, and governing law) will survive.

Changes to these terms

We may update these Terms from time to time by posting a revised version on the Service and updating the "Last updated" date. Material changes will take effect when posted, or on a later date we specify. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service and cancel any paid subscription.

Governing law and disputes

These Terms are governed by the laws of Denmark, without regard to conflict-of-law rules. The courts of Denmark have exclusive jurisdiction, subject to any mandatory consumer protections that apply in your country of residence.

General

These Terms are the entire agreement between you and Kewise regarding the Service and supersede prior agreements on the same subject. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
